\n<\/strong>CLARIFICATION TEXT REGARDING PROCESSING OF PERSONAL DATA<\/strong><\/p>\n

Dear Candidate,<\/strong><\/p>\n

Including your personal data with special characteristics (nationality, penal conviction and information for security measures, biometric information and the like) that you have shared within the scope of the employment application that you have made to our Company, the Yenig\u00fcn \u0130n\u015faat Sanayi ve Ticaret A.\u015e. (henceforth, it shall be referred to as \u201cYenig\u00fcn\u201d) all of your personal data, all of your personal data that was previously processed \/kept and all of your related personal data to be processed \/ kept after the submission of our clarification text will be able to be processed or be able to be transferred to the third persons in the ways indicated below based on the legal reason of obtaining your express consent in accordance to the 1st<\/sup> Sub article of the 5th<\/sup> Article of the Law of Protection of Personal Data Numbered 6698, being limited by the purposes indicated in this Clarification Text:<\/p>\n

1. Data Supervisor<\/strong><\/p>\n

In accordance to the Law of Protection of Personal Data Numbered 6698, your personal data will be able to be processed, recorded, kept, classified, updated by Yenig\u00fcn as the data supervisor within the scope explained below in accordance to the law and the rules of honesty and be disclosed \/ transferred to the 3rd<\/sup> persons in cases where the regulations permit and\/or being limited by the purposes for which the data is processed and to the countries where the centers of the data storage systems, which it uses, are located.<\/p>\n

2. Purposes of Processing Personal Data<\/strong><\/p>\n

Your collected personal data will be able to be processed within the personal data processing conditions and purposes indicated in the 5th<\/sup> and 6th<\/sup> Articles of the Law of Protection of Personal Data for the purposes of providing the execution of the human resources policies of the Yenig\u00fcn, execution of the business and service processes, evaluation of the potential business opportunities and determination and application of commercial and business strategies.<\/p>\n

Your personal data will be able to be processed for the execution of the service processes within the scope of the related regulations and primarily the Law on Protection of Personal Data. In this framework, your personal data is processed within the conditions and purposes of processing personal data indicated in the 5th<\/sup> and 6th<\/sup> articles of the Law on Protection of Personal Data. In this regard, the Yenig\u00fcn, with the title of Data Supervisor, processes your personal data for the purposes of providing execution of the human resources policies, evaluation of the potential business opportunities and determination and application of the commercial and business strategies.<\/p>\n

In this scope, your mentioned personal data is kept safely in the physical or electronic setting for the duration of the time which is appropriate for its purpose of processing. Within the scope of the mentioned activities, Yenig\u00fcn acts in accordance to all of the obligations regarding the protection of the personal data stipulated in the all related regulations\u00a0 and primarily the Law on Protection of Personal Data.<\/p>\n

3. To Whom and for Which Purposes the Processed Personal Data May be Transferred<\/strong><\/p>\n

Your personal data, which is processed within the scope of the purposes explained above, will be able to be transferred to our business partners in accordance to the basic principles stipulated in the Law of Protection of Personal Data, and within the purposes and conditions of personal data processing indicated in the 8th<\/sup> and 9th<\/sup> articles of the Law on Protection of Personal Data, to the firms from which support services are obtained in the matter of human resources for the purpose of performing our activities, and to the independent auditing companies within the framework of legal necessities and limitations.<\/p>\n

Your personal data will not be used other than the purposes indicated above and it will not be shared with or transferred to the third persons except the legal obligations and official organizations \/ institutions.<\/p>\n

4. Method and Legal Reason of Collecting Personal Data<\/strong><\/p>\n

Your personal data is collected by the Yenig\u00fcn in accordance to the regulations either directly from you or through various venues such as partnerships, affiliates, and solution partners with whom the Yenig\u00fcn cooperates or has a contractual relationship.<\/p>\n

Your personal data which is collected in this regard, may be processed and transferred within the scope of the conditions and purposes of personal data processing indicated in the 5th<\/sup> and 6th<\/sup> articles of the Law of Protection of Personal data and purposes indicated in the 2nd<\/sup> and 3rd<\/sup> Articles of this Clarification Text.<\/p>\n

5. Measures Regarding Protection of Personal Data<\/strong><\/p>\n

The Yenig\u00fcn takes all kinds of technical and administrative measures which are necessary regarding the matter of protection of the personal data.<\/p>\n

6. Rights of the Owner of the Personal Data Listed in the 11th<\/sup> Article of the Law of Protection of Personal Data<\/strong><\/p>\n

In accordance to the 11th<\/sup> article of the Law of Protection of Personal Data, your rights as the related person whose personal data is processed are as follows:<\/p>\n

  1. Learning about whether your personal data is processed or not,<\/li>\n
  2. Requesting information regarding processing of your personal data if your personal data is processed,<\/li>\n
  3. Learning about the purpose of processing your personal data and whether your personal data is used in accordance to its purposes or not,<\/li>\n
  4. Learning about the third persons to whom your personal data is transferred domestically and internationally,<\/li>\n
  5. Requesting the correction of your personal data in the event that your personal data is processed incompletely or wrongly<\/li>\n
  6. Requesting the erasure or destruction of your personal data within the framework of the terms stipulated in the Law of Protection of Personal Data.<\/li>\n
  7. Requesting the erasure or destruction of the personal data and the notification of the procedure conducted within this scope to the third persons to whom your personal data is transferred, in the event that the reasons for processing your personal data no longer exist despite the fact that your personal data is processed in accordance to the stipulations of the Law Numbered 6698 and other related Laws.<\/li>\n
  8. Objecting to the emergence of an outcome which is against you by analyzing your processed data exclusively through the automated systems,<\/li>\n
  9. Requesting elimination of your losses in the event that you incur losses due to processing of your personal data against the law.<\/li>\n<\/ol>\n

    In accordance to the 1st<\/sup> Sub Article of the 13th<\/sup> Article of the Law, you may make your application in writing for the purpose of using your rights indicated above in any case to the in accordance to the 5th<\/sup> Article of the Communique Regarding Methods and Principles of Application to the Data Supervisor issued by the Board of Protection of Personal Data, by adding substitutive documents proving your identity through registered mail by sending the mail to the address of Birlik Mah. 488. Sok. No: 7 06610 \u00c7ankaya \/ ANKARA or through the notary public.<\/p>\n

    In regards to the submitted request, your personal data which is processed by the Yenig\u00fcn will be determined in full by determining your relationship with the Yenig\u00fcn and a reply will be given to your related application correctly and within 30 days to the latest without having the need to pay any fees. In the event that the procedure requires an additional cost, the fee in the tariff determined by the Board of Protection of Personal Data will be requested from the related party.<\/p>\n

    The Yenig\u00fcn reserves the right to request your personal information or additional documentation and information (copy of the id card or driver\u2019s license) for determining the identity and authorization for the purposes of eliminating the legal risks that may originate from sharing data illegally and unfairly, providing the security of your personal data, and verifying that the person making the application is the related person. In the event that the information regarding your conveyed requests are not correct and updated or in the event that an unauthorized application was made, the Yenig\u00fcn declines responsibility due to the requests originating from the mentioned wrong information or unauthorized application.<\/p>\n

    7. Request for Updating Your Information<\/strong><\/p>\n

    Your personal data that we collect needs to be correct and updated when needed. Thus, in the event that a change happens in your personal data, you may inform this matter to the Yenig\u00fcn.<\/p>\n
